On October 24, 2022, Brooks was given the chance to offer the defense; however, due to Brooks's repeated misbehavior and failing to follow decorum, Judge Dorow ruled that he had forfeited his right to call further witnesses and declared the evidentiary stage of the trial over. Closing arguments began October 25, and the jury deliberations began that same day. Brooks had been arrested three weeks prior to the Waukesha attack for hitting his ex-girlfriend, and ramming the woman with the same vehicle during a domestic dispute at a gas station in Milwaukee.
